Terms of Use

These Terms of Use govern your access to and use of The Yum Pandemic platform. By creating an account or using our service, you agree to these Terms and our linked policy pages.

1. Scope and Agreement

These Terms of Use ("Terms") are entered into between you and Mr Andrew Tzionis trading as The Yum Pandemic, with registered address at Shop 3, 16 Christaki Kranou, Potamos Germasoyia, Limassol 4041, Cyprus ("we", "us", or "our"). The Yum Pandemic is not operated through a registered company. These Terms, along with our Privacy Policy, Cookie Policy, Community Guidelines, AI Content Policy, and Regional Legal Annexes, govern your use of the Platform. In the event of a conflict, the terms of the applicable Regional Annex will prevail to the extent of your local mandatory consumer laws.

2. Eligibility and Account Registration

  • Minimum Age: You must be at least 16 years old to create or keep an account. We do not permit under-16 accounts, and no exception is currently available for younger users.
  • Information Accuracy: You are solely responsible for honestly and accurately providing and maintaining your date of birth, country of residence, legal acceptance and other account information. You must not conceal or misrepresent your location or country information.
  • Security: You are solely responsible for keeping your credentials secure and for all activities under your account. Notify Email us immediately of any unauthorised use.
  • Account Limits: Individuals may hold one personal account. Businesses, brands, and restaurants may hold one professional account per entity.

3. Source Material and Original Contributions

  • Source Material Ownership: You retain ownership of any rights in the photographs, recipe information, ingredients, instructions, stories, comments, text, and other material you submit to the Platform ("Source Material").
  • Original Blogs: You retain ownership of an original blog or narrative that you write and submit without Platform generation. A blog composed or substantially generated by the Platform is Generated Platform Content rather than an original user blog.
  • Processing Licence: You grant Mr Andrew Tzionis trading as The Yum Pandemic a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, copy, analyse, moderate, process, reformat, translate, and use your Source Material, including through third-party AI and image-generation services, to create, publish, promote, and operate transformed or generated content and the Platform.
  • Retention and Publication: The licence continues for as long as reasonably required to provide the service, maintain published Generated Platform Content, preserve moderation and provenance records, meet legal obligations, resolve disputes, and maintain proportionate backups. Requests for access, export, or deletion of Source Material are handled under the Privacy Policy, but deletion does not require removal of Generated Platform Content that no longer contains your personal data or protected expression.
  • Representations: You warrant that you own or have all necessary rights to submit the Source Material and grant this licence, and that the Source Material does not infringe any third-party intellectual property, confidentiality, or privacy rights.
  • Account Deletion: When an account is deleted, user-owned Source Material and private or personalised generated assets are erased unless a narrow legal retention purpose applies. Eligible public or reusable Generated Platform Content may remain under The Yum Pandemic only after verified provenance and removal of personal identity and protected user expression. Ambiguous material is not automatically transferred.

4. Platform Content and Intellectual Property

  • Platform Rights: All materials, code, branding, layouts, editorial recipes, Generated Platform Content, designs, and software on the Platform are owned by or licensed to Mr Andrew Tzionis trading as The Yum Pandemic, to the extent such rights legally exist.
  • Restrictions: You may not scrape, crawl, bulk-download, decompile, copy, or commercially exploit Platform content without our prior written consent. This restriction does not prevent you from using our authorised self-service account-data archive for your own account data and eligible Source Material.
  • AI Training Prohibited: You are strictly prohibited from using Platform Content or user profiles to train machine learning models or artificial intelligence systems.

5. Food Safety, Allergens, and Health Disclaimers

  • Not Professional Advice: Recipes, nutritional calculation tags, ingredient substitutions, and dietary labels on the Platform are for general information and inspiration only. They do not constitute professional nutritional, dietary, or medical advice.
  • Allergen Risks: Allergen labels are generated as a general guide and are not guaranteed to be accurate. Always check original ingredient packaging and consult a medical professional if you have allergies, intolerances, or dietary restrictions.
  • Safe Preparation: Cooking times, temperatures, and handling recommendations are guides only. Always follow safe food-handling practices.
  • Untested Recipes: AI-generated and user-submitted recipes are not professionally tested. Verify all instructions and quantities before preparing.

6. AI-Assisted Content and Outputs

  • AI Feature Availability: The Platform offers generative AI features for recipe enrichment, image generation, and publishing workflows.
  • Generated Platform Content: As between you and us, Mr Andrew Tzionis trading as The Yum Pandemic owns any rights that legally exist in recipe text, images, editorial enhancements, layouts, and other content generated or independently created by or for the Platform from Source Material ("Generated Platform Content"). This does not transfer ownership of your Source Material to us.
  • No Warranties: We do not warrant that Generated Platform Content is original, copyrightable, or non-infringing. Any permitted use of Generated Platform Content is at your own risk.
  • Transparency Disclosures: In accordance with the EU AI Act and similar regional transparency rules, you are responsible for disclosing when content you publish is AI-generated.

7. Alcohol Content and Regional Restrictions

  • Age Gate: Alcohol-themed recipes, cocktail posts, and beverage promotion are intended only for users of legal drinking age in their declared country of residence. We use your declared date of birth and country of residence, together with request-country signals for logged-out visitors, to apply these restrictions.   • Regional Filtering: We apply country-level restrictions to hide or restrict access to alcohol-related content in jurisdictions where the promotion or consumption of alcohol is legally restricted or prohibited. See Regional Legal Annexes for details on restricted countries.
  • Professional Advertising: Professional users promoting venues, drinks, or brands must comply with local licensing laws, advertising standards, and age-verification protocols. Alcohol promotion remains hidden where local rules or platform policy prohibit it.

8. Subscriptions, Fees, and Stripe Payments

  • Pricing and Tiers: The Platform offers Free, Home Cook, Chef, and Professional subscription plans. Current features and pricing are detailed on our Subscriptions page.
  • Stripe Managed Payments: Paid subscriptions use Stripe Managed Payments. Stripe or Stripe Link acts as merchant of record for the transaction. Ordinary Stripe Payments is not used as a fallback. By purchasing, you also agree to the applicable Stripe or Link payment terms. The Platform does not store full card data.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled. Checkout identifies the recurring price, billing interval, automatic renewal, and cancellation route before purchase.
  • Country Declaration: The billing country you provide to Stripe or Link must be honest, accurate, current, and consistent with your declared country of residence. We may refuse Checkout, withhold subscription activation, stop renewal, or cancel or refund a transaction where country information is missing, inconsistent, or outside the countries currently supported for Stripe Managed Payments.
  • Country Checks: Checkout availability is assessed using your declaration, available request-country signals, and billing-country information made available by Stripe or Link. These checks reduce, but cannot eliminate, location errors and do not guarantee a transaction's tax treatment.
  • Tax Responsibility: Stripe or Link remains merchant of record for a Managed Payments transaction. Where Managed Payments tax coverage does not apply, The Yum Pandemic may retain legal obligations that cannot be transferred to you by these Terms. Nothing in this clause limits mandatory consumer rights.

9. PDF Exports and white-label assets

  • Usage Rights: Home Cook and Chef tiers support personal PDF recipe exports. The Professional tier supports commercial, branded, and white-label cookbook exports.
  • Rights After Downgrade: If you downgrade or cancel your subscription, existing generated assets remain available in your account, but you cannot generate new Professional-tier exports.
  • Third-Party Assets: Rights to use design templates, embedded fonts, or stock media in exported PDFs are subject to the third-party licenses provided by the Platform.

10. Moderation, Suspensions, and Appeals

  • Safety Audits: We reserve the right to review, remove, edit, or restrict any content that violates these Terms or our Community Guidelines.
  • Account Restrictions: Repeated copyright infringement (complying with US DMCA and EU ePrivacy rules) or safety violations will result in account suspension or termination.
  • Appeals: If you believe your content was removed or your account restricted in error, you may file an appeal by contacting Email us.

11. Disclaimers, Liability Caps, and Indemnity

  • As-Is Basis: The Platform is provided "as is" and "as available" without warranty of any kind.
  • Liability Cap: To the maximum extent permitted by law, our aggregate liability for all claims is capped at the subscription amount paid by you for the subscription period giving rise to the claim. If you use a Free account and paid no subscription amount for the relevant period, our aggregate liability is limited to EUR 0 where permitted by applicable law.
  • Consequential Damages: We are not liable for any indirect, incidental, or consequential damages, loss of profits, data, or goodwill.
  • Indemnity: You agree to indemnify and hold harmless Mr Andrew Tzionis trading as The Yum Pandemic from any third-party claims, costs, or damages arising from your Source Material, original contributions, or violation of these Terms.

12. Governing Law and Disputes

  • Cyprus Law: These Terms and any dispute arising out of them are governed by Cyprus law.
  • Courts: Disputes will be resolved in the courts of Cyprus, except where mandatory consumer laws of your home country grant you the right to bring proceedings in your local courts.
  • Consumer Savings: Nothing in these Terms limits or waives your non-waivable statutory rights under local consumer protection laws (such as UK Consumer Rights Act, Australian Consumer Law, or US state laws). For regional jurisdictions overrides, see Regional Legal Annexes.
